Yes. In Ontario, real estate closings require a real estate lawyer. Licensed and insured lawyers register ownership documents in Ontario’s land registration system. We recommend checking the Law Society of Ontario’s directory and researching the lawyer and law firm you are hiring.
How soon can I speak with a lawyer?+
In most cases, you can speak with a real estate lawyer the same day you contact our office during business hours. We also strive to make ourselves available on weekends and holidays for urgent matters. Your first call may be answered by a staff member or associate who will help direct your matter to the appropriate lawyer. Availability must be confirmed with the office.
Is there any up-front payment for closings?+
In most cases, you don’t pay legal fees or expenses until after your real estate closing is complete. The office will confirm the payment arrangements and any exceptions for your matter.
What is title insurance?+
Title insurance is a one-time insurance policy that protects property owners and mortgage lenders against certain problems related to ownership or title. Depending on the policy, it can cover issues such as title fraud, unpaid liens, survey errors, encroachments, forgery and certain legal defects. Your lawyer conducts searches to confirm ownership and identify registered issues, but some problems may not appear in searches or public records. Title insurance can provide additional protection against covered hidden risks, including associated legal fees and financial losses. In Ontario, it is commonly obtained during closing; owner coverage generally remains in place for as long as you own the property. Coverage and exclusions depend on the policy.
Who will sign the closing documents?+
Everybody who holds title to the property should sign the required documents. This can usually be done electronically or in person at our office, subject to the transaction, lender requirements and identity verification. We will confirm the signing process for your file.
